Evans instructed A to release his grip. There was a tussle during which the Civil Justice Centre's security staff and Mr Evans tried, and eventually succeeded, in obtaining A to release Mr Evans. The event is captured on CCTV which will be played at the appeal hearing. A stated that he was attempting a lawful citizen's arrest because he alleges that Mr Evans had perverted the course of justice when he (Mr Evans) previously appeared for the Crown in A's othe/s matters. APPLICATION 2_1 The matter is neither a sexuai offence, nor involves a child witness and therefore the relevant section is s.36 Youth Jtlstice and Criminal Evidence Act I999 (hereafter "the act".) 2.2 An application is made for the Court to prevent A from cross examining Gareth Evans (lP), Sonny Saar (security guard) and John Thomas (security guard) pursuant to section 36 of the Act. 2.3 It is feared that if A were permitted to cross examine directly, the cross examination would be unduly lengthy, that is would be repetitious and encroach on irrelevant matters. lt is the Crown's position that Mr Evans in particular was under cross examination for a particularly long time during the Magistrates' Court and some matters put to him were of an improper nature.
